In all cases where a passenger does not pay the penalty fare at the time of inspection, the ticket inspector records the passenger’s personal details and completes a Record of Transport Inspection (hereinafter referred to as the “ZOPPK”), a copy of which is handed to the passenger.
Personal data of passengers who fail to pay the imposed surcharge on the spot during a ticket inspection are processed in accordance with Act No. 110/2019 Coll., on the Processing of Personal Data, and may, in this regard, be used for the recovery of the outstanding debt and transferred to law firms, courts, and enforcement officers.
Rights and Obligations
The legal relationship between the passenger and the carrier within the Prague Integrated Transport system (PID) is governed in particular by Road Transport Act No. 111/1994 Coll., Section 18, as amended, and Railways Act No. 266/1994 Coll., Section 37, as amended. These laws define the fundamental obligations of both the passenger and the carrier during transport. The carrier’s obligations are carried out by a person authorised by the carrier, i.e. the driver or a transport inspector who is equipped with an inspection badge and an official carrier identification card (hereinafter referred to as the “authorised person”).

The passenger is obliged to:
comply with the Transport Regulations, the PID Transport Conditions and the PID Fare Tariff,
follow the instructions and orders of the authorised person issued to ensure transport safety, smooth operation and the protection of all passengers,
present a valid travel document at the request of the authorised person at any time during transport or while present in the transport area,
if unable to present a valid travel document, pay the fare and the surcharge, or present an identity document issued by a state authority and provide personal details (first name, surname, date of birth, delivery address and identity document number) required for the recovery of the penalty,
in the event of a breach of the Transport Code, pay the prescribed surcharge or present an identity document issued by a state authority and provide the personal details (first name, surname, date of birth, delivery address and identity document number) required for penalty recovery. Breaches of the Transport Code include, for example, smoking, consumption of food and drinks, disruptive or noisy behaviour, etc.,
if the penalty is not paid at the time of inspection or if an identity document is not presented, remain at the place of inspection or accompany the ticket inspector to a police department for the purpose of identity verification.

In addition to issuing instructions and orders to ensure passenger safety and the smooth operation of transport:
exclude from transport any passenger who, upon request by an authorised person, fails to present a valid ticket and fails to pay the fare and surcharge, exclude a passenger from transport or impose a surcharge on a passenger if, despite warnings, they fail to comply with the Transport Code, instructions, and orders of an authorised person, litter the vehicle, or disturb the peaceful transport of passengers or exhibits any other antisocial behaviour towards other passengers; exclusion from transport must not endanger the safety and health of the passenger in question,
refuse to transport or exclude from transport any luggage, passenger, or animal transported with them if they constitute an obstacle to the safe and comfortable transport of passengers or endanger the health of passengers, or if their transport is not permitted by the Transport Conditions, in particular if such constitutes an obstacle to the occupancy of the vehicle,
impose a penalty on any passenger who fails to present a valid travel document or otherwise breaches the provisions of the PID Transport Conditions, require payment of a surcharge, or require the passenger to provide personal identification details.
